3. User Responsibilities

When using our services, you agree to:

  • Provide accurate and complete information as requested
  • Maintain the confidentiality of any account credentials
  • Use our services only for lawful purposes
  • Not attempt to reverse engineer or extract our AI models
  • Comply with all applicable laws and regulations
  • Not use our services to develop competing products without authorization

4. Intellectual Property

All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, AI models, algorithms, and software, are the exclusive property of MTech and are protected by international copyright, trademark, and other intellectual property laws.

Custom AI solutions developed specifically for clients become the property of the client upon full payment, unless otherwise specified in a separate agreement. MTech retains the right to use generalized knowledge and techniques gained during client projects.

5. AI-Generated Content

When using our AI services, you acknowledge that:

  • AI-generated outputs may vary and are not guaranteed to be error-free
  • You are responsible for reviewing and validating all AI-generated content
  • You will not use AI-generated content for illegal or harmful purposes
  • MTech is not liable for decisions made based on AI-generated insights

6. Limitation of Liability

To the maximum extent permitted by law, MTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the services
  • Any conduct or content of any third party on the services
  • Any content obtained from the services
  • Unauthorized access, use, or alteration of your transmissions or content
  • Errors or inaccuracies in AI-generated outputs

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the services will be uninterrupted, error-free, or free of viruses or other harmful components. AI model performance may vary based on input data quality and use case complexity.

8. Indemnification

You agree to defend, indemnify, and hold harmless MTech and its licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  • Your use of and access to the services
  • Your violation of these Terms of Use
  • Your violation of any third-party right, including intellectual property rights
  • Any claim that your content caused damage to a third party

9. Payment Terms

Specific payment terms for our AI services will be outlined in individual service agreements or statements of work. Generally:

  • Deposits may be required before project commencement
  • Milestone payments may apply for larger projects
  • Late payments may incur interest charges
  • All fees are non-refundable unless otherwise specified

10. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of our engagement. This includes business strategies, technical specifications, AI model details, and any other information marked as confidential.

11. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Use. Upon termination, your right to use the services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the services after any changes constitutes acceptance of the new terms.
